These Terms of Service (“Terms”) govern your access to and use of RankChecker, the search-ranking and AI Overview visibility tracking service available at rankchecker.com and rankchecker.com/app (the “Service”), operated by FourthMedina, Inc. (“RankChecker,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly at [support@rankchecker.com] if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account.
2. The Service
RankChecker tracks keyword positions in search results and the presence of, and citation in, AI Overviews, for the domains, keywords, locations, and devices you configure. We provide trend data, alerts, and related reporting.
We may add, change, or remove features, and we may set and adjust usage limits (such as the number of tracked keywords or manual on-demand checks) according to your plan. We will use reasonable efforts to keep the Service available but do not guarantee uninterrupted or error-free operation.
3. Accuracy and no guarantees
The ranking, position, and AI Overview data we provide is derived from automated checks and third-party search-data sources. Search results vary by time, location, device, personalization, and other factors outside our control. The data is provided for informational purposes only, on an “as is” basis, and we do not warrant that it is accurate, complete, current, or reflective of what any individual user sees. You should not rely on it as the sole basis for business decisions. We do not guarantee any particular ranking, traffic, or business outcome from using the Service.
4. Subscriptions, billing, and refunds
The Service offers a free tier and paid subscription plans. Plan features and prices are described at rankchecker.com/pricing and may change.
Payment provider. Payments and subscriptions are processed by our payment provider, Lemon Squeezy, which acts as merchant of record. Your purchase is also subject to the payment provider’s terms. By subscribing, you authorize recurring charges to your payment method for the applicable fees until you cancel.
Renewals. Paid plans renew automatically at the end of each billing period (monthly or annual, as selected) at the then-current price, unless you cancel before the renewal date.
Cancellation. You may cancel at any time through your account or the payment provider’s customer portal. Cancellation stops future renewals; you retain access until the end of your current paid period.
Refunds. Except where required by law, fees are non-refundable, and we do not provide refunds or credits for partial periods or unused features. Any refunds we choose to grant are handled through the payment provider.
Taxes and price changes. Prices may be exclusive of taxes, which may be added by the payment provider. We may change prices with notice; changes apply to the next billing period.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or third-party rights.
- Track keywords or content that are illegal, or that you are not permitted to monitor.
- Resell, sublicense, or provide the Service to third parties except as expressly permitted by your plan.
- Attempt to access the Service through unauthorized means, circumvent usage limits, or interfere with or disrupt the Service or its infrastructure.
- Scrape, reverse engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by law.
- Use the Service to build a competing product, or to overload, probe, or test the vulnerability of our systems without authorization.
We may suspend or limit access if we reasonably believe your use threatens the security, integrity, or availability of the Service or violates these Terms.
6. Intellectual property
The Service, including its software, design, text, and branding, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. You retain ownership of the data you submit (such as the domains and keywords you track). You grant us a license to process that data as necessary to provide the Service.
7. Third-party services
The Service relies on and links to third-party services (including authentication, payment, hosting, email delivery, and search-data providers). We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.
8. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends, and we may delete your data in accordance with our Privacy Policy, except where retention is required.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that data will be accurate.
10. Limitation of liability
To the maximum extent permitted by law, RankChecker and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) [USD 50 / your chosen floor]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless RankChecker and its owners, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there, except where applicable law gives you the right to bring proceedings elsewhere.
